Terms of Service & Safety Disclaimer

Welcome to X9 Scooters LLC (“Company,” “we,” “us,” or “our”). These Terms of Service and Safety Disclaimer govern all purchases, services, rentals, and use of electric bicycles, electric scooters, parts, accessories, and related equipment provided by X9 Scooters LLC.

By accessing our website, purchasing products, receiving services, or operating any equipment obtained from X9 Scooters LLC, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Assumption of Risk

Electric bicycles and electric scooters involve inherent risks, including but not limited to falls, collisions, loss of control, mechanical failure, road hazards, traffic conditions, weather conditions, and rider error.

By purchasing or using any product from X9 Scooters LLC, you voluntarily assume all risks, known and unknown, associated with the operation and use of electric mobility devices.

2. Ride at Your Own Risk

All products are used entirely at the rider’s own risk. X9 Scooters LLC makes no guarantees regarding rider safety and is not responsible for injuries, damages, or losses resulting from use or misuse of any product.

3. Safety Gear Recommendation

Riders are strongly encouraged to wear proper safety equipment at all times, including but not limited to:

  • A certified helmet

  • Protective gloves

  • Proper footwear

  • Protective riding apparel

Failure to wear safety gear significantly increases the risk of serious injury or death.

4. Compliance With Laws

Riders are solely responsible for understanding and complying with all applicable local, state, and federal laws, regulations, and ordinances related to electric bicycles, electric scooters, and personal electric mobility devices.

X9 Scooters LLC does not provide legal advice regarding rider compliance.

5. Pre-Ride Inspection Requirement

Before each ride, riders must inspect the equipment, including but not limited to:

  • Brakes

  • Tires

  • Throttle

  • Bolts and fasteners

  • Battery charge level

  • Lights and electrical systems

Do not operate any equipment if a defect, malfunction, or safety concern is detected.

6. Responsible Operation

Riders agree to operate all equipment responsibly, including:

  • No operation under the influence of alcohol, drugs, or impairing substances

  • No reckless riding, excessive speeds, racing, or stunts

  • Maintaining awareness of pedestrians, vehicles, and surroundings

7. Battery Safety

Lithium-ion batteries must be handled with extreme care. Riders agree to:

  • Use only manufacturer-approved chargers

  • Avoid exposure to water or extreme temperatures

  • Never open, modify, puncture, or tamper with battery packs

Improper battery handling may result in fire, explosion, injury, or property damage.

8. Modifications & Repairs

Unauthorized modifications, aftermarket parts, or improper repairs may:

  • Void manufacturer warranties

  • Compromise equipment integrity

  • Increase the risk of injury or failure

X9 Scooters LLC is not responsible for any damages, injuries, or losses resulting from altered or improperly repaired equipment.

9. Warranty Disclaimer

X9 Scooters LLC does not provide in-house warranties on electric scooters, electric bicycles, batteries, electrical components, or accessories.

All warranties, if applicable, are provided solely by the manufacturer.

X9 Scooters LLC may perform manufacturer-authorized warranty repairs only after the manufacturer approves the claim.

Manufacturer warranties may cover approved replacement parts only. Labor, diagnostics, and installation performed by X9 Scooters LLC are not covered and are the responsibility of the customer unless the manufacturer states otherwise.

X9 Scooters LLC is not responsible for warranty approvals, denials, defects, or manufacturer response times.

10. Limitation of Liability & Release

To the fullest extent permitted by law, the rider releases, waives, and holds harmless X9 Scooters LLC, its owners, employees, agents, and affiliates from any and all claims, demands, damages, injuries, losses, or liabilities arising from or related to:

  • Use or misuse of equipment

  • Accidents or collisions

  • Improper maintenance

  • Unauthorized modifications

  • Battery failure or electrical issues

11. Rider Responsibility & Minors

Riders are responsible for operating equipment within their skill level and exercising sound judgment at all times.

Minors may only operate equipment under strict adult supervision. The supervising adult assumes full responsibility for the minor’s actions and safety.

12. Acceptance of Terms

By purchasing, using, servicing, or operating any equipment from X9 Scooters LLC, you confirm that you have read, understood, and agreed to these Terms of Service and Safety Disclaimer in full.

13. Governing Law & Venue

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

Any legal action or proceeding arising out of or relating to these Terms, or the purchase or use of any products or services provided by X9 Scooters LLC, shall be brought exclusively in the state or federal courts located within the State of Florida. You consent to the personal jurisdiction and venue of such courts.
